On July 14th 2008, Senator Schumer called on the U.S. Department of Commerce to immediately declare a \"Commercial Fishery Failure\" in the Great South Bay caused by a record outbreak of brown tide. For more than 20 years, brown tide outbreaks have crippled boating and fishing in the Bay, particularly the clam fishing industry. Senator Schumer was joined by Brookhaven Town Supervisor Brian Foley.
